This Agreement sets forth the terms and conditions ("Terms") which apply to your use of which are offered to you by ToysRCollectables.com. Orders
1. ALL SALES ARE FINAL. Only damaged merchandise will be accepted for return.
2. Most purchases will be shipped within 10-14 business days after payment is received. If your order is going to be delayed for any reason we will try and notify you. Purchases are shipped via United States Postal Service.
3. All Products are shipped in Good Condition.
4. Buyer shall examine all merchandise promptly on receipt thereof. Buyer shall notify Seller of all claimed shortages or damaged merchandise within two (3) days of receipt of goods. Failure to give notice shall be deemed an acceptance of the goods as of the date of shipment.
5. Orders can only be cancelled if they have not been processed. All Credit Card orders are processed within 24-48 hours of receipt.
6. Prices in effect at the time of purchase are final. Credit will not be given for any subsequent change in price. No exceptions.
7. If you have any question about anything, please give us a call at 817-313-4196. All prices displayed on ToysRCollectables.com are quoted in U.S. dollars.
You, as a buyer, are responsible for shipping and handling charges, which will be calculated into the price but will NOT show up in your shopping cart upon ordering.
ToysRCollectables.com reserves the right, without prior notice, to discontinue or modify our service(s) or product(s) prices without incurring any obligation to you.
The receipt by you of an order confirmation does not constitute ToysRCollectables.com's acceptance of an order. Verification of information may be required prior to ToysRCollectables.com's acceptance of an order. We, ToysRCollectables.com, reserve the right to accept or decline your order at any time after receipt.
In the event that a product or service is listed at an incorrect price due to supplier pricing information or typographical error, ToysRCollectables.com shall have the right to refuse or cancel orders placed for the product listed at the incorrect price, regardless of whether the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, ToysRCollectables.com shall promptly issue a credit to your credit card account in the amount of the incorrect price.

Indemnification
You agree to defend, indemnify, and hold harmless ToysRCollectables.com and its subsidiaries, affiliates, agents and employees, ToysRCollectables.com's vendors, and their affiliates and related entities and their respective directors, officers, employees, and agents from and against all claims, demands, causes of action, losses, damages, liabilities, expenses and costs including but not limited to reasonable attorneys' and expert fees as well as court costs, arising in law or equity, which may be asserted alleging or arising out of your breach of these Terms or your access to or use of ToysRCollectables.com. The foregoing indemnification obligation shall survive termination of these Terms, ToysRCollectables.com and any product or service provided to you arising out of or relating to your use of ToysRCollectables.com.

Governing Law, Jurisdiction, and Venue

You hereby agree for yourself and your properties that the courts sitting in Denton County, Texas, shall have sole and exclusive jurisdiction and venue over any matter arising out of this Agreement and hereby submits yourself and its property to the venue and jurisdiction of such courts. NO JURY TRIAL YOU WAIVE YOUR RIGHTS TO A TRIAL BY JURY IN ANY PROCEEDING WITH ToysRCollectables.com.
Invalid Provision
If any provision of these Terms shall be determined to be invalid or unenforceable, the Terms shall be deemed amended to delete such provision or such provision shall be modified to the extent necessary to make it enforceable and the remainder of the Terms shall be enforceable.
Retail Value
Shop At Home uses retail values during our sales presentations. These retail values represent either an actual price based upon comparison shopping or the price at which Shop At Home believes that the same product, comparable product or a product sold separately would be offered by other retailers using a standard markup for that product category. The retail value may not represent the prevailing retail price in every community and does not represent the price at which an individual would be able to sell the product.
Force Majeure
ToysRCollectables.com shall not have any liability to you thereunder by reason of any delay or failure to perform any obligation or covenant if the delay or failure to perform is occasioned by force majeure, meaning any act of God, storm, fire, casualty, unanticipated work stoppage, power outage, satellite failure, strike, lockout, labor dispute, civil disturbance, riot, war, national emergency, act of Government, act of public enemy, or other cause of similar or dissimilar nature beyond its control.
